The headlines blare over at the New York Times: “Ethics Trial Expected for California Congresswoman.” (Since when were these called trials, anyway?) And the CW weathervanes have concluded that this series of “trials” will harm Democratic efforts to hold onto the House in November.
I guess because you have two black members of Congress embroiled in ethics violations and hearings before the relevant committee, you could pair them up and spin out some kind of Democratic-specific controversy. But the similarities really do end there. Rangel, in my considered opinion, is guilty. His own defense in the case of multiple ethics charges basically admits guilt. He says that he was inattentive to various tax issues, and that other members of Congress took similar junkets to him but weren’t charged with anything. Whether Rangel eventually receives a reprimand or not, people clearly are talking about resignation, and even the President is talking about the longtime New York Congressman ending his career with dignity.
By contrast, here’s what Waters has been charged with:
A House ethics subcommittee has charged Ms. Waters, 71, a 10-term congresswoman, in a case involving communications that she had with the top executive of a bank that her husband owned stock in while it was applying for a federal bailout in 2008, two House officials said [...]
Ms. Waters, at the time the investigation by the House ethics panel began last fall, was accused of intervening on behalf of OneUnited, a Boston-based bank. The Times reported last year that Ms. Waters called Treasury Secretary Henry M. Paulson Jr. in 2008, as the economy was in a free fall, to ask him to host a special meeting with executives from black-owned banks.
As a key House player on the Financial Services Committee, Ms. Waters often called Mr. Paulson. He agreed to arrange the requested meeting, The New York Times reported last year.
What Mr. Paulson did not know at the time was that Ms. Waters’s husband, Sidney Williams, owned stock in and had served on the board of OneUnited, whose chief executive turned the Treasury headquarters meeting into a special appeal for bailout assistance. The executive of the institution, one of the nation’s largest black-owned banks, asked for $50 million in federal aid, The Times reported.
It’s entirely possible that this is as fishy as it sounds, I suppose. But this case has been around for well over a year, and the evidence in it actually supports Waters’ view of the events. Here’s Zachary Roth:
Waters’ office has released to TPM two letters sent by the National Bankers Association (NBA), a trade group for minority-owned banks, to the Treasury Department, in reference to a September 2008 meeting Waters had helped set up between NBA and Treasury. The letters appear to back Waters’ contention that the meeting, at which OneUnited’s CEO reportedly asked explicitly for bailout money, was not set up exclusively to help OneUnited, but rather on behalf of minority-ownded banks more broadly.
That doesn’t contradict anything the New York Times reported, it’s worth noting. But it does appear to bolster Waters’ claim, made in a statement she put out earlier today, that she wasn’t looking out for OneUnited’s interests above those of other minority-owned banks. Waters has long been an advocate in Congress for minority-owned banks.
Waters also released a 2007 document showing that she disclosed her ties to OneUnited — her husband had previously served on the board, and owned stock — before questioning witnesses at a House hearing on minority-owned banks.
If Waters is guilty of anything, it’s not disclosing to Treasury what she disclosed in open testimony in the House. Still, it’s hard to conclude she was doing much of anything here beyond advocating for minority-owned banks.

Waters is fighting charges that do not seem to be much more than a slight misstep in disclosure, literally nothing compared to the astounding greed we’ve seen as a result of corporate lobbying. I can think of dozens of cases off the top of my head, from Democrats and Republicans, that make this look just silly in comparison, starting with the allegations of financial services industry fundraisers on the eve of votes on FinReg in the House last December.
You don’t have to carry a torch for Maxine Waters to know that her case is wholly different than the case of Charlie Rangel’s, and that they’re being placed together because of coincidental timing and skin color.

It’s not quite so straightforward. Robert Cooper, who went with Waters to see Treasury, was and still is senior counsel for OneUnited Bank. At the time he was also President-elect of NBA, which is how he represented himself at the meeting. (Other minority owned banks have complained that NBA is a front group for OneUnited.) Finally this story did not begin in 2008. For decades Waters has been plagued by accusations of insider dealings.
I agree as to why we’re focusing on these two. Harry Reid made his fortune purchasing property, using his influence to get it rezoned, and then flipping it at enormous profit. No one talks about it outside of Nevada. It’s a definite double standard.
This is payback. Rangels and Waters were both Clinton supporters.
Several wingers already are talking about creating a swamp of continuous investigations if they can get a majority, and no one will be surprised if they choose such a course. This is the same crew that wuold not put enough members on the Ethics Committee to make it functional while Tom Delay was still in danger of being indicted.

Where ever this is coming from, it would be nice to see some pushback from the left. How about more attention to Ensign’s problems including Tom Coburn’s attempt to bribe a potential witness? Or both Coburn’s and Ensign’s ties to The Family.
How about investigating The Family for unconstitutional interference with government in violation of its tax-exempt status? Why not more fire directed at them the same way ACORN was attacked and ruined?
I’m sick of this. Obama comes in and plays nice with the former administration and instead of those criminals getting investigated and prosecuted we get Democrats thrown under the bus, and black Democrats at that. Smeels like the smears thrown at Reconstruction governments 140 years ago.
re Rangle. His lawyers have pointed out that white rethug senators have done(are doing) the exact same thing he is accused of in 10 of the counts. Which is why-my understanding after reading all I could find-Rangle refused a deal. Which in turn po’ed not only the rethugs mentioned but also the people who are doing the ethics charges-now why would these people be pissed? Other than the fact that they are bringing charges against 2 long time BLACK democratic reps and ignoring the ethics problems of various WHITE rethugs. So why do this so close to elections? Yeah, I thought the same thing when I first read about this. But, I thought about it with Way. Fewer. Words. Nevertheless, thanks for the post.
These recent attacks on blacks in government by white people are not coincidental. And Obama has been appalling with regard to them.
This is not about Republican or Democrat its about corruption in government. I am always surprised how people are willing to overlook unethical actions just so they can stay in power. A similar complaint was mentioned in the media but never had an ethics complaint filed. This one involved Sen. Inouye of Hawaii. He had an ownership stake in a bank here that needed bailout money from the federal government. A member of his staff made a phone call on behalf of the bank and all of a sudden the money was approved. The linked article below talks about this and also mentions the Waters case. I’m a Democrat and its our responsibility to ensure that we drain our swamp no matter who is involved.

Both of these cases are bullshit.
But the fact that Republicans are doing it too does not lessen Rangel’s culpability. At best he’so careless with his finances he shouldn’t be trusted with a responsible job, at worst he’s probably guilty of tax evasion.
What I think is happening is that the Democratic leadership, Obama, Pelosi, etc. were planning on quietly shoving Rangel and Waters under the bus. The problem with that plan is that Rangel and Waters see “going with dignity” as putting up the best damn fight they can muster. It is going to turn into a major political drama. I am sure that there are many “truths” involved in this story, but the political reality is the the Democrats have lost control of the situation.
Show trials?
Rangel, Waters, and Eric Massa were all a pain in the ass for House leadership, in one way or another. They were all more supportive of real health care reform, for instance, than Pelosi and Hoyer. They are the only three so far, among all the possibilities, who are being reviewed for ethics violations.
I think when the truth finally emerges about all this, the color involved is likely to be green. One certainly has to wonder about the sudden and very specific interest in ethics that the House leadership has suddenly developed.

I totally agree with you, but here’s my comment to what you say: dream on, dreamer!
The fact is that, for better or worse, Dems are far more willing to throw other Dems, esp those such as Rangel and Waters, under the bus than Republics EVER will be willing to do with “their own” (with some minor exceptions). That says a lot about the power of the corporations, and much less about ethics and all that kind of folderol.
It’s all about “follow the money,” and who’s willing to scratch who’s back. I’m all for investigating Rangel and Waters to see if they did something wrong, etc. However, I’m mightily tired of the endless circus sideshow that passes for our laughingly called “government” these days (maybe always??).
It’s eminently predictable that BLACK Democrats will be treated with more scorn and scrutiny than a WHITE Republican. Period. The end.
And most of this can be labeled: IOKIYAR.

No, Dave, they’re not. The Waters case may be shaky, but an associate of mine who is close to the Waters family flatly says, “She’s has dirty as shit.”
Rangel, on the other hand, is guilty of multiple crimes, including tax evasion and the illegal use of three rent controlled/rent subsidized properties.
While it may be true that because they’re black they’re getting more heat and scrutiny, that, per se, doesn’t change the fact that they have committed offenses which warrant investigation, and perhaps even criminal charges.

If, among promoting other GOP policies, you want to help Obama cut/privatize Social Security in December, please by all means keep holding Waters to a higher standard than everyone else in the House.
What bullshit. I have no interest in promoting GOP policies, nor do I care to support most of Obama’s Republican-in-Dem-clothing policies, and I’m as big a foe of the Catfood Commission and Obama’s backdoor attempt to gut Social Security and Medicare as anyone here. (I’d venture to say, even more so than some.)
Who say’s Waters is being held to a higher standard? Let’s see what the investigation, hearings, “trial” bring out. I remind you that over the years lots of corrupt white House leaders of both parties have not only been subjected to ethics investigations but ended up either out of Congress or in jail, or both. Just off the top of my head, there’s former Speakers Jim Wright (D), Newt Gingrich (R), and Tom Delay (R), plus former Ways and Means Chairmen Dan Rostenkowski (D), and Wilbur Mills (D), plus Bob Ney (R), etc. I’m sure if I googled the issue I could find more.
Do you want Repugs to defend their corrupt House members just because they’re Republicans? If not, don’t ask or expect us to defend corrupt Dems just because they’re Dems.
Just to be clear, I’m all for the vigorous prosecution of Ensign by the Senate and/or the DOJ. But let’s remember that the House can only investigate and sanction House members. House ethics investigations may tangentially uncover corruption involving Senators or members of the Exec branch, but all the House can do is refer that info to the Senate ethics committee, the DOJ, or if it involves the military, the DOD.

Forgetting income has been sport, as well as having job related expenses that were not reimbursed, for as long as I have been alive (don’t ask – :-) )
And rent control violation is a bit cleaner than the C street house lies, IMO.
Rangel’s 13 violations are beyond petty and unworthy of ethics action.
As for Maxine, she actually has used her office for her investments – but the connection was adequately hidden (given an everyone a millionaire Congress it becomes hard to be pure relative to ones wealth).
This ethics investigation misuse (depth of investigation and topic is even beyond chasing mail stamp return money- and that was a real theft of money albeit it tiny) is not possible without Whitehouse support – and leadership. Obama is yet again attacking progressives – and being a real “black” rather than a dark skin white boy in Indonesia may now be a political crime if you are a progressive.
I grew up in and know Chicago rules and process – this smells like Chicago. A zoning change flip that Reid could not control the zoning on that someone above was chasing Reid in Nev about is nothing compared to GOP state and country games of controlling infrastructure contracts so as to dictate road paths, buying options on property in that path, passing the public funds, and ordering the state or county agency to settle quickly with the “owners” for the “taking”. The above is the reason for the lack of logic for Fairfax County road building – the mini beltway around Arlington – in Northern Virginia – all pointed out before and during the process by local media, but the GOP fellows did not care and went ahead – albeit delayed by a few years. This ethics violation party is Obama and his staff – perhaps not their idea but they had to give permission to run with it.
My point also – nothing here rises to the level of “crime” – unlike converting the office stamps and keeping the money.
The GOP have nothing – but it required Obama approval to get the Dems to chase these two. And that has to be seen as a simple attack on progressives by Obama and staff.

And BTW, I don’t know who you were referring to with respect to taking money for stamps, but as I recall, Rostenkowski went to jail for, among other things, having ghost employees/no-show employees on his staff payroll and taking the money.
I’m interested why we haven’t heard more about Ackerman’s [conflict of interest/ethics?] stock deal esp. considering the position he holds on the foreign affairs committee. Interesting Melanie Sloan hasn’t made a comment on this story?
