BP is aggressively challenging the government’s estimate of the oil spill in the Gulf, because that final number will determine how much they’ll owe in fines:
BP’s lawyers are arguing that the government overstated the spill by 20 to 50 percent, staffers working for the presidential oil spill commission said Friday. In a 10-page document obtained by The Associated Press, BP says the government’s spill estimate of 206 million gallons is “overstated by a significant amount” and the company said any consensus around that number is premature and inaccurate.
The company submitted the document to the commission, the Justice Department and the National Oceanic and Atmospheric Administration.
“They rely on incomplete or inaccurate information, rest in large part on assumptions that have not been validated, and are subject to far greater uncertainties than have been acknowledged,” BP wrote. “BP fully intends to present its own estimate as soon as the information is available to get the science right.”
This is just comical, and proves where the priorities are within BP. The most important number for the company who claims to be committed to restoring the Gulf is not number of dead wildlife, or illnesses and fatalities from Gulf residents, but the amount of oil spilled, because a reduction in that number will reduce their financial exposure by billions.
Well, they have a fiduciary duty to shareholders, right, so that trumps discomfort with sociopathy, I guess. Still, the number that concerns me the most is not 206 million gallons, it’s 80. As in 80-mile kill zone.
A mile below the surface in the Gulf of Mexico, there is little sign of life.
“It looks like everything’s dead,” University of Georgia professor Samantha Joye said.
In an exclusive trip aboard the U.S. Navy’s deep-ocean research submersible Alvin, ABC News was given the chance to observe the impact of this summer’s massive oil spill that most will never see.
The ocean floor appears to be littered with twigs, but Joye points out that they are actually dead worms and that Alvin is sitting on top of what is considered an 80-square mile kill zone.
The oil is actually all there for the counting. No bacteria ate it. It has settled at the bottom of the Gulf, and it’s devastating the local ecosystem.
In case you were wondering.

About FDL News Desk
David, I’ve spent many late nights watching and listening to interviews and VIP discuss this. Mostly, all I’ve gotten from it all is that there are steps in place to remove all residents from the Gulf area. It seems that big biz has a need there and the citizens are not needed.
The VIP are disappointed that they were only able to get rid of worms and not the residents of the Gulf area who are only in the way.
“BP’s lawyers are arguing that the government overstated the spill…”
Jesus-fucking-Christ, Obama and his administration were shaving points for BP like a crooked NBA point guard in the playoffs.
Clutching head and groaning… so sad. I don’t know anymore. I just don’t know.
When I read the headline to this post, my instant response was: Naturally!!
Thanks for the info. It’s really horrible.
Step 1: Spray Corexit (dispersant) in the hundreds of thousands (if not millions) of gallons.
Step 2: Spend $50M on a touchy-feely, happy-talk, “we’ll make it right…” ad campaign
Step 3: Lie through your teeth (under oath and otherwise) about how many gallons of oil were actually spilled. (“Prove us wrong. We don’t see anything”) (See Step 1)
Step 4: “Our estimates show that approximately 26 gallons of sweet crude were spilled, all of which were skimmed off the surface and pumped into one oil barrel.”
Hell, I could run that f-n company. It ain’t exactly rocket science.
To add insult to injury, NO ONE is behind bars.
As Gomer Pyle would say “Surprise! Surprise! Surprise!” Peace
But but but, the US needs BP’s oil to fuel its missions in Iraq, AfPak, and now Yemen to spread democracy!
It’s consistent with our expectations of BP and the Obama government, at any rate.
80 miles of oil on the bottom. Everything animal and vegetation is dead.
And I still think the folks down there have not gotten much of their money.
Sickening
I’m sure the Obama Administration will negotiate with BP’s lawyers until they all agree that the government overstated the spill by no less than 60 to 80 percent.
Obama is a bad joke.
AND THE KILLIN’ GOEZ ON AND ON AND…
Citizen David Dayen and the FDL Patriots:
Who coulda predicted that BP would contest the government’s estimate of the spill…oh yeah, everyone did while they were pullin’ Obama’s chain and killin’ the Caribbean. My God, it is time to take over the Democratic Party precict by precinct, city by city and district by district. The hollowed out structure of party politics and the nationwide network of the internet makes that possible…haven’t seen a lotta FDLers at meetings lately, time to walk the walk folks.
KEEP THE FAITH AND PASS THE AMMUNITION, NOWHERE TO HIDE ANYMORE!!
If the US was a true representative democracy it would have nationalized the oil industry a long time ago. as a wholly owned corporate entity, America exists to increase the corporate bottom line. period.
the travesty is the long term damage to the gulf ecosystem that will not be known for many years.
how many more new horizon type disasters need to occur before people realize that we only have 1 planet, one shot to get it right?
Is the GOP set to take over the House in Jan? Yes
Did Obama let BP get away with killing the Gulf of Mexico? Yes
The GOP house is going to seek ways to let BP off the hook, and of course blame Obama. (the GOP is going to have to do a little dancing here, because most of the gulf states are GOP strong holds)
A real Democrat would have destroyed BP,
A trojan horse like Obama? will let BP get away with killing Gulf, and yes help the GOP set them free.
You got to love trojan horses, they make back stabbers look like nice people.
The ugly thing is that the administration will let them lower it by 40 percent and then in six months or so they’ll come back and tell us that it’s still overestimated by half or more. By the end of it all, it will turn out to have been just one BP employee emptying his car’s oil change into the Gulf.
But as Tony Hayward said, the GOM is a BIG ocean.
In fact, when the polar icecaps melt, it will be an even BIGGER ocean! Let’s get that job done quickly!
Yep. Let’s pack six billion plus people into an ever smaller area with ever shrinking resources. As log as the rich and privileged remain rich and privileged, it’s a win-win! Well, except for the little people and we don’t count.
Nah…Obama will go for broke. He’ll say that it was actually FDL that spilled the oil, and that the US owes BP a trillion dollars to cover their losses.
Tony Hayward and Obama have a lot in common
Obama says “Wikileaks bad”
Obama says “Gulf Of Mexico being kill by BP No Big Deal”
Obama is not a hard person to understand, if it makes the rich, richer GOOD, he is just like his brother Bush
Like Bush says who needs the Planet Earth, We got Texas!
I blame the Obama administration for taking the easy way out here.
Imposing a penalty, to be determined over years, would have been the fair way, especially since it was BP’s management that led directly to the spill.
Factors to determine the penalty would have included losses to the fishing industry due to the spill. The costs would then drive the industry to make changes, driving up the costs of oil, which would then accelerate changes in the way the US consumes oil.
It is just like capping medical malpractice awards takes away any incentive for the medical industry to make healthy choices.
The payments to the Obama welfare fund from BP will now increase as the no. of gallons spilled goes south. Barry’s a crook a Chicago style goon, I’m ashamed I ever voted for him.
No, by the end of it all, the US will be apologizing to BP for having wells that don’t behave properly, just like Harry Whittington apologized to Dick Cheney for getting in the way of his bullet.
Good Morning David and Firedogs -
Naomi Klein has just returned from a 4 day Gulf trip with Univ. South Florida researchers (NOAA did everything to shut them down and/or discredit them) looking forward to her write ups

anyone know the schedule for FDL’s coverage of the Prop 8 / 9th Circuit live blog ?
Jane has a fresh cross-post ready: Obama Takes Credit For Bush’s NAFTA-Style Korea Free Trade Deal He Once Opposed
Without too much of a fishing investigation, someone should be able to come up with some grounds to impeach him.
Oh wait, the Reparasites would never impeach one of their own.
Actually they should triple the fine as BP so underestimated what they were actually spilling. I am trying to say that nicely as we all know they were outright lying to our faces form day 1.
I have an issue with impeaching someone just because you can. Clinton was impeached for lying to a court while nothing was done to our torturer, George W. Bush when we sure could have impeached him for a lot of things, including wiping out habeas corpus and almost the entire Bill of Rights under the Military Commissions Act of 2006!
I am sure they will try and impeach Obama though they know, just like Clinton, the Repulikans do not have the votes to convict him.
I want to vote him out, not cost taxpayers $300 million or so because one wants to play political games.
I ran across this yesterday from New Orleans Ladder.
Gulf loop current and Gulf Stream Broken Affecting Europes Climate
BP will pay less than agreed upon cause the feds will fold to their argument. This is just like the tax cut issue.
And this from the gulf coast..
Fishermen Question Gulf Seafood Safety
The White House is planning to serve seafood from the Gulf of Mexico at Christmas events this year, in a move aimed at boosting consumer confidence in the wake of the BP oil spill. But some locals are questioning the safety of seafood from the area. http://www.newslook.com/videos/271856-fishermen-question-gulf-seafood-safety?autoplay=true
As a lifelong democrat/progressive, I will dance naked if someone…anyone..would impeach this hack and remove him from office so the republicans won’t be able to point to him in 2012 and say:
“There he is, folks; the head of the democratic party. Want another 4 years?”
Joe Biden, just from the name-change alone, would be worth some seats in the house and senate…plus, depending on just how batshit-crazy the repubs nomination process is, it might let us keep the White House.
C’Mon, i KNOW he’s done something that we can pin on him.
