Late Thursday night, the Justice Department fired off a letter to the Secretary of State of Florida, Ken Detzner, asking that he put a stop to the purging of voter rolls that could leave hundreds if not thousands of legal US citizens stripped of their right to vote.
The Justice Department sent a letter to Florida Secretary of State Ken Detzner Thursday evening demanding the state cease purging its voting rolls because the process it is using has not been cleared under the Voting Rights Act, TPM has learned.
DOJ also said that Florida’s voter roll purge violated the National Voter Registration Act, which stipulates that voter roll maintenance should have ceased 90 days before an election, which given Florida’s August 14 primary, meant May 16.
Five of Florida’s counties are subject to the Voting Rights Act, but the state never sought permission from either the Justice Department or a federal court to implement its voter roll maintenance program. Florida officials said they were trying to remove non-citizens from the voting rolls, but a flawed process led to several U.S. citizens being asked to prove their citizenship status or be kicked off the rolls.
This aligns with the wishes of a coalition of Florida Congressional Democrats, who wrote to the state asking for the voter purge to be stopped, as well as independent lawsuits which cite the violation of the National Voter Registration Act. The pre-clearance provisions of the Voting Rights Act would only affect the five counties under its jurisdiction, but the NVRA applies for all of Florida.
The full letter can be found here. The Civil Rights Division of the Justice Department, which under the Obama Administration has been far more aggressive in rooting out civil rights violations, sent the letter. They seek a response by next Thursday, June 6.
A spokesman for the Florida Department of State tells Think Progress that “We just received the letter from DOJ this evening, and haven’t had a chance to thoroughly review it. Bottom line is we are firmly committed to doing the right thing and preventing ineligible voters from being able to cast a ballot.” Keep in mind that Detzner is the second Secretary of State under Rick Scott; the first, Kurt Browning, resigned in January, possibly because of the numerous changes to voting rights laws engineered by Scott. One of them, an election law that included hardships for independent voter registration drives, was just overturned yesterday by a federal judge.
I should add that the DoJ letter refers to “news reports” that alerted them to the voter purge scheme. Think Progress in particular should be commended for bringing this issue to light. Practically all of the traditional media ignored it; the New York Times, even today, gives it short shrift at the end of a story on the judge’s ruling on voter registration suppression. It took progressive media to raise awareness of this scheme to take away the voting rights of thousands of Floridians, part of a larger war on voting being attempted in Republican legislatures across the country. Scott, following in the footsteps of Jeb Bush, thought he could get away with it. He still might. But the DoJ is clearly preparing to fight them on it, and that would not have happened without a media willing to blow the whistle.

Thanks for the coverage…Of course, why should Fla be suspect? B/c of the history and giving us W, in part. Very troubling and apparently the state officials continue still to turn a blind eye. Hope DOJ stays on it.

A perfect example of useless federal posturing. The letters have gone out, the ‘suspects’ have already been intimidated and there’s no court order demanding the purged voters be reinstated or that new purges come to a dead stop. The damage is ongoing.
Elite mentality at its worst. Blatantly break the law, scoop up the money/benefits/contracts/ and when the Sheriff timidly asks a question… do nothing. The elites know they’ll be able to keep their loot no matter what happens as there is no such thing as prosecution in this country for their class. Worse, if there was prosecution for, oh, say, stealing $2 billion dollars, they know that after ten years fighting it in the courts, the fine will be somewhere in the range of $100,000 — less than the tax they’d pay on their stolen money.
Agreed. But keep in mind that there are special crossovers, such as Corzine. He is both Obama’s Job and the 1%.
I know a lot of people started calling the WH or emailing them to get on this. I wonder if Obama just doesn’t concern himself all that much with what’s going on in this country? He probably thinks it’s a good idea anyway.

From what I understand of the Federal court ruling, it’s time for the League of Women Voters to hit the ground running in Florida and get people registered. No more threat of penalty for doing so. And every other organization, including the Girl Scouts, teachers unions….go go go….Valdemort loses this one and time for his criminal ways to accompany him into the courts and prison. He knew what he was doing.

Rick Scott is not George Bush’s brother but he is his partner.
Scott was one of the owners with George Bush when they were part of the Texas Rangers owners group.

Republican election fraud can only occur because Democrats allow it to exist.
It’s the same every election: 1. Prior to the election, remove non-white people from registered voter lists; 2. Intimidate and mislead non-white voters on election day – offer them a never-counted, provisional ballot; 3. Collect and count the vote on electronic systems that are incapable of verification; 4. After the election, Democrats look surprised and say, “Wow, never saw that coming. But if we bring up the issue of election fraud, people will loose confidence in the system, resulting in a depressed voter turnout.”
Republican election fraud will always be concentrated in Florida and Ohio as Republicans can not win without one of these states.
Bob McChesney says that, Demographically, Texas should be a Blue state. I figure Democrats will not organize in Texas because Republicans are not competitive in national elections without winning Texas – got to keep veil of two political parties up, otherwise the hoi polloi will see through to the oligarchy.
I agree. It’s refreshing to read even if not necessarily new. To me, a no-brainer. What possible point (that contains any maturity) could there be in sitting it out? Do you suppose they’ll bask in sanctimonious pleasure at seeing everyone get what they deserve–fucking Mitt Romney?
If someone really thinks they can justify not voting at all, please speak up. But you probably should not let any Arab Spring fighters hear you. They’re dying in the streets for the right to vote.
