In one of the more cynical campaign promises I’ve seen in a while, the Obama Administration has apparently been running around to housing advocates telling them they will fire Ed DeMarco as head of the Federal Housing Finance Agency… after the election.
In 2010, Senate Republicans opposed Mr Obama’s choice to replace Mr DeMarco and have since said they would be unwilling to support other candidates who support principal reduction schemes. Administration officials have argued there are few qualified candidates willing to take the demanding position. Some borrower advocates have argued that the White House has kept Mr DeMarco in office in part because it provides the administration with an easy excuse when questioned about why they have not done more to prevent millions of home seizures.
But in the past few weeks, Obama administration officials – including Gene Sperling, director of Mr Obama’s national economic council, and Jon Carson, director of the White House’s office of public engagement – have told Democratic groups that they hope to oust Mr DeMarco in the coming months, most likely by replacing him via an appointment while Congress is not in session, according to people familiar with the matter.
Administration officials have asked housing groups to supply a list of potential candidates. Officials made their statements most recently on September 13 during a White House housing summit.
This is just an unbelievable manipulation. Ed DeMarco has been running FHFA since August 2009. At no time over the three years, including at least a small portion when Democrats held 60 votes in the Senate, was there any impediment to replacing DeMarco. The White House waited a year-plus to name a nominee for replacement (Joseph Smith, the banking commissioner in North Carolina and the current oversight monitor for the foreclosure fraud settlement). They named him in the lame-duck session and withdrew the name by January. There hasn’t been a replacement since, and clearly no idea of who to replace him, since the White House is ASKING THE HOUSING GROUPS FOR RECOMMENDATIONS three years later.
Now, it’s a close election, and every little bit of help counts, so the White House leaks that maybe, if their guy gets re-elected, they’ll dump DeMarco. But it all depends on the election, of course. It’s hard to be shocked by cynical politics, but this certainly comes close.
Meanwhile, on the same day this leaks, the US Attorney for Manhattan, Preet Bharara, sues Bank of America for $1 billion over their sale of loans to… Fannie Mae and Freddie Mac (I guess now Bharara can say he “got tough” on the banks in his Attorney General confirmation hearing in the Senate). The FHFA, of course, has had an active lawsuit for over a year against BofA and 16 other banks, over the sale of mortgage backed securities to… Fannie Mae and Freddie Mac. The lawsuits attack slightly different parts of that transaction, with the FHFA lawsuit a pure misrepresentations and warranties case on MBS, while the US Attorney seeks damages on the guaranteeing of mortgages. But the USA case builds on the FHFA lawsuit; the FHFA Inspector General is a party to it. Do you think for a second that the government won’t try to fold everything together and settle the cases, especially in the absence of a hard-charging DeMarco, who has been very aggressive on seeking MBS repurchases?
I happen to disagree with DeMarco on principal reduction, but he has been excellent on repurchases, and the Administration probably would take the trade of eliminating liability for the banks in exchange for a few scraps for homeowners. Moreover, the banks would take the trade as well; the exposure from the MBS issuance is far greater.
My point is that the reason for the White House wanting DeMarco gone, all of a sudden, are potentially more obscure than people want to admit. And that assumes that they will follow through on this promise to make a recess appointment, based on nothing more than “re-elect us and we’ll swear to do it this time” comments from senior Administration officials.

obama must be sweating this reelection! Maybe some really rich person has decided to change the script on obama at the last minute (trump drama ahaha) and now obama feels compelled to finally take charge of his own housing policy. Thats just so unfoamy I don’t know what to think. Tell you what obummer name someone like Neil Barofsky to head the fhfa and then Ill maybe believe your serious, but your still not getting my vote.
There are some good quotes in the DOJ complaint against Bank of America (PDF Warning: about 4 MB). But the PDF won’t permit me to save it as text.
The complaint is a good basic tutorial on “this is what FIRREA lets prosecutors do,” in particular, how FIRREA creates a civil cause of action to recover a million bucks per violation for certain “criminal predicate offenses.” DOJ alleges mail fraud and wire fraud, specifically, and explains that civil penalties are $1 million per violation or, in the case of continuing violations, “up to $5 million or $1 million per day, whichever is less.” [Complaint, pp. 8 & 9.]
You clearly have idea on how to get the things that you want done out of politicians.
You can get what you want, but it has to be solely on your terms.
Which is a big reason why politicians that you support rarely win and rarely get what you are asking for.

Q: Why should taxpayers foot the bill for principal reduction?
A: Because WS lapdog Obama won’t make the banks pay.
No kidding. And furthermore, whom do they propose replacing DeMarco with? Why should I clap with joy over this proposal without knowing who the replacement will be? Given Obama’s track record, it surely wouldn’t surprise me if it was someone worse who was even more in the tank for the Banks.

I must confess that it does seem as if Barry is running a bit scared lately. I am on record here saying that I thought Barry’s second term was in the bag, so to speak. Maybe the 1%ers have lost their love of him now that Mittens is promising even more gargantuan grift and graft to them???

I just don’t think Obama is “running scared”, but he must keep lying or else he’ll disappear. He’s set for life whether he wins or loses, and realistically he can accrue more wealth at a faster pace if Romney wins the election. Bill Clinton now enjoys an estimated net worth of $200 Million, the majority of which was accumulated after his time in office.

Just wondering out loud here, but the recent spate of CEOs threatening their employees about their voting habits could/would be a symptom of WS money abandoning Obama.
That’s what I’m wondering about, plus there was a recent New Yorker article (which you have to pay to see) about the SALT conf in Las Vegas (where both Al Gore & Sarah Palin got to “entertain” the mighty ones), where I guess there was a tremendous amount of vetching & whining about how teh horrid Obama is to the 1%.

I thought the independent status enjoyed by DeMarco pretty much precluded firing him unless he got caught kiting a check or shoplifting.
Obama could, however, offer him a plum post as Ambassador somewhere. . .
The Obama administration often does pay for votes in good coin. So, just maybe they will follow through on this. On the other hand, who knows what the replacement will be like?

Why hasn’t Obama fixed the economy when it’s obvious that he is so very economical?
The man is recycling all the promises he made in 2008 and running on them in 2012.
Imagine what a landslide this election would be if he had delivered on his 2008 promises during his first term, instead of doing the opposite of what he promised in so many instances.
A health care bill with no mandate and a strong public option.
The most transparent administration ever.
Restoring the Constitution.
On those three alone, I would be standing outside my polling place right now to make sure I was first on November 6.
As it is, I may be the first on that line anyway, because I am that eager to vote for Dr. Stein, even knowing she will lose.
P.S. Remember when Obama promised to fix his Senate vote after he got elected in 2008, but then he doubled down on it instead? See, very economical.
Campaign money is not his problem.
Votes may be his problem, though, assuming that the vote is not already fixed by one side or another. (Yes, boys and girls, Democrats fix them, too.)
