This David Petraeus sex scandal has, as is usually the case, launched thousands of columns claiming to understand intimate details about the mental states of everyone involved, striking moral tones about who can be blamed and what it means for the moral fabric of family life in America, the military, what have you. But the really interesting and important aspect of this story is the degree to which the FBI completely abuses the public trust, apparently for no more a reason than a favor to a friend.
Consider the origins of this case. Paula Broadwell, Petraeus’ mistress and biographer, sent some vaguely angry emails to Jill Kelley, who is described as an “unpaid social liaison at MacDill Air Force Base, Florida.” Broadwell allegedly saw Kelley groping Petraeus under a table, and sent Kelley emails – she hacked into Petraeus’ off-books email account to get the address – that really didn’t say anything threatening.
But Kelley had a hold card – a friend at the FBI. Specifically, a friend at the FBI who wanted to get into her pants.
Ms. Kelley, a volunteer with wounded veterans and military families, brought her complaint to a rank-and-file agent she knew from a previous encounter with the F.B.I. office, the official also said. That agent, who had previously pursued a friendship with Ms. Kelley and had earlier sent her shirtless photographs of himself, was “just a conduit” for the complaint, he said. He had no training in cybercrime, was not part of the cyber squad handling the case and was never assigned to the investigation.
But the agent, who was not identified, continued to “nose around” about the case, and eventually his superiors “told him to stay the hell away from it, and he was not invited to briefings,” the official said [...]
Later, the agent became convinced — incorrectly, the official said — that the case had stalled. Because of his “worldview,” as the official put it, he suspected a politically motivated cover-up to protect President Obama. The agent alerted Eric Cantor, the House majority leader, who called the F.B.I. director, Robert S. Mueller III, on Oct. 31 to tell him of the agent’s concerns.
OK, so the FBI has someone on their payroll who likes to sext. But he also likes to cajole his colleagues into investigating a case of unwanted cyberstalking emails, without actual threats attached to them. And from this, they basically commandeer the private communications of multiple people. Today we learn about inappropriate communications between Kelley and John Allen, the NATO commander for Afghanistan, who replaced Petraeus there (it’s on the order of hundreds of emails, not 20-30,000 as first reported). What does this have to do with the Kelley-Broadwell-Petraeus case? Who at the FBI leaked the Allen investigation, which appears to be about at most flirtatious emails only and probably not even a crime?
Because this cybercrime investigation eventually involved high-ranking national security figures, and fundamentally became a security scandal, with Petreaus allowing Broadwell access to secret information, that perhaps justifies the FBI’s interest in the case. But this is all after the fact. At the outset, the FBI had a tip from someone about six harassing emails. Why did they start in on this to begin with? And how much power have we handed over to a domestic agency, which can apparently sequester and geo-locate any email account on the planet? And this was all done without informing members of Congress, unless you count Agent Shirtless thinking that slow-walking in the case represented an Obama plot, leading him to spill his guts to Eric Cantor.
So this is not a scandal about sex, to me. It’s about the power of the surveillance state.

Here you are, presented with a hugely salacious bunch of tidbits, now all expensively “lawyered-up”, and yet you want to actually consider deeper implications?

Of course, the key is that the Hotel California is working perfectly. You don’t leave. You have to change it. The technical term for this (when it comes to whole societies) is revolution. Somebody owns the Hotel, and is benefiting from it. That’s the point at which the song fails as a metaphor for social change.
However, the left just wants to take over and have full control of the thing, without having to answer to the current owner. But the left has no intention of carrying anyone’s bags up to their room for them, ever. That’s the job of the working class. The left will manage the Hotel from air conditioned offices, thank you.
If Petraeus was an ordinary citizen, I would agree with you. If he were a member of Congress, I would still probably agree with you. But as the head of the CIA, nope, I have to disagree with you. If it looks like our head spy is up to scandalous behavior, that makes him ripe for blackmail. This is at the heart of all the background checks for every security clearance issued, whether low level “confidential” clearances or the top most clearances, which Petraeus must possess. The FBI has an obligation to look into anything that might compromise the head of an agency, especially the head of a clandestine agency.
For once, government snooping into a person’s underwear drawer seems to have actually been appropriate.
Stalinist Soviet Union would have same powers to keep the “loyal” followers in line only then they had to open your mail physically to read it. We are in a police State now.
Its not about blackmail, its the fact that the head of CIA could have had accounts hacked and other info exposed.
One commentator on one of the shows last night played up the shirtless agent and I think this may be why this even had legs. Sounded like he was of the FOX/Tea Bagger ilk and was using his position for fishing against O.
Its also my understanding that fairly soon into this, the FBI decided that this was a nothing and dropped interest. Had Petraous waited another couple of months to resign then its doubtful most of us would have ever heard of this story.
My personal thought is that Petreous was concerned that this story would surface while testifying and would have lead to a really disgraceful scandal.
If the players were normal citizens then you might have overreach, but frankly I am kinda glad the FBI is keeping tabs on the CIA director.
I agree with you, and I’m willing to bet good money that anyone in the upper echelons of the military, CIA, FBI, or you-name-it has no legal expectation of privacy in terms of their ‘personal’ email accounts.
The nanny state, which the GOP strangely pushed for, all while crying fire about burdensome regulation is out of hand. However, I expect leaders in security apparatus to be scrutinized carefully and if they can’t handle it they should seek work elsewhere. I have no pity for Petreus. He follows a long line of narcissist men who supposedly cannot control their wieners.

The scandal is that this scrutiny occurred because of a jealous woman instead of through vigilant security measures.
It also proves what every Mata Hari already knows: you could have the sterling standard of security and still get in through the zipper.
The FBI is doing its job backwards. They need to do a better job of vetting their employees. Shirtless photo? Taking down the election? Funny,seems the only one who did the appropriate thing was Cantor.

And that some Republicans might be wondering why Eric Cantor droned one of their own.
Basically, the affair should never have become public. It is not for the FBI to report to the public the details of peoples’ consensual private sex lives. This entire episode is about the surveillance state and is also about the hysterical bent towards sexual moralizing. The fact that a newspaper would even publish a report on the extra-marital affair shows that high-ranking editors and reporters at newspapers have no decency either.
I don’t think that–as you assert, David–that you or anyone else can assert they’re going to tell us ‘the one really important thing’ about the case. Yours–here–is the libertarian left case, and regards personal and sexual freedom, etcetera.
Other issues involve–the massive power to surveil at all (more important, where I thought you were going when I saw the title; and the effect on little things like whether we bomb Iran, which almost no analyst seems to care about.
Why–I’d like to know–do both this and the Woodward memo come out after the election? How do all of the right, far right, and crazy right figures and their intrigues play into this? And (finally) why ISN’T it important if someone’s dalliances open the possibility of various other hands accessing important information?

I recently traveled through a small airport in NY. I am a middleaged white lady. After a very sketchy young man threw a hissy fit about not wanting his not-legal sized bottles of suspicious stuff going through xray (hmmm!) and making a scene, I was treated to a full frontal massage without warning. THEN this same suspicious person was STILL allowed on my small plane. He was jumpy while we waiting for a weather delay and went into the restroom and lit up a cigarette! Only then was he escorted off the plane.
This event is adding to my outrage.
“Security measures” are BULLSHIT. This Petraeus Affair is just more evidence that no one knows what the fuck they are doing.

This story is about the surveillance state: it’s a disturbing example of what the villains can and will do. But Petraeus is a villain, too, and this story is also about the sharp edge of karma. Is Petraeus being taken down for the right reasons? No. But is he getting precisely what he had coming to him? You bet he is. I hope he loses his appetite and has a lot of sleepless nights; I hope he can’t show his face in public again without experiencing stomach-churning, searing disgrace. He owes the world far more than that, but it’d be a good start. (Yes, I know the policies of endless war and endless dishonesty will continue. I’m still glad that this man’s career is a smoking ruin.)

To me this demonstrates one thing very clearly: All the surveillance, torture, war and imprisonment of the last 11 years never–never!–had anything at all to do with “safety” and “security.”
It’s not just about the power of the surveillance state. It is about the power of a supposedly democratic state to create secrets in the first place.
It is also about the unexorcised ghost of J. Edgar Hoover, which stalks the FBI with secret side files useful for political and blackmail purposes.
If we believe the likes of Patraeus, if we take these people at their word, if we accept what the TV tells us that all the surveillance and war is designed to keep US citizens safe, then, yes, the Patraeus’ of the country don’t know what the fuck they are doing. However, if we consider that the purpose of the surveillance state is domestic control, then they know exactly what they are doing.
Look at the personnel and policies of airport “security.” Does this look to you like the purpose is to thwart terrorists?
Maybe the surveillance state has another goal that can be detected not by the words of their propaganda but by their actions?

I live in a small town of about 50,000 people. By my rough estimation, there is about one security camera for every 100 citizens. Parking lots have them, the cops have them, the public University has them. The Super Walmart alone has around a hundred of them. We put surveillance cameras in the bedrooms of our children and likewise imagine that it is for purposes of safety and “for their own good.” There is a reason the US is a surveillance state, and it is not solely due to the actions of its “leaders.” You show me a population that is scared shitless, and I’ll show you folks with a fetish for surveillance.
Or, as you point out, we have no problem when we are doing the surveilling but go ape shit when we are the objects of surveillance. Well, we know how to stop this bullshit then, don’t we.
The FBI agent in this matter has/had a political agenda.
Karl Rove worked in concert with a FBI agent when he was still in texas to smear/indict political opponents right before the election- then the charges would be dropped.

First we had several media conservatives (Limbaugh, Morris, Scarborough (sort of), etc.) telling their electorate that it’s going to be a Romney landslide. And now we find that Cantor knew that someone high up in the Obama administration was having an affair, but chose not to leak this to Fox News or Limbaugh. Come on, folks, this is fucking Eric “Sell his own mother for a stick of gum” Cantor were talking about here and you want me to believe that he just sat on this information. Not in a million years.
So now all of us Democrats, thanks in large part to our clever bluedog media, will be taking the blame for the Republicans mishandling of the economy and foreign affairs while globalization marches on. (MMXVI: The Brother, The Latino and The Blossom…)
